Summary: Murder trial 5 years after events — Delay in criminal proceedings undesirable but whether fair trial could take place primarily for trial judge to decide and since no application made for stay had been made no abuse of process — Trial judge’s confusing directions on essential aspects of case and failure to identify for jury facts supporting appellants’ defences effectively deprived them of chance of manslaughter verdict and so case remitted for murder convictions to be quashed and convictions for manslaughter substituted
