JCPC Delivers Judgement for Marlon Taitt

Mr. Taitt was convicted of murder in 2008 in the High Court of Trinidad and sentenced to the mandatory death penalty.

His appeal against his conviction was dismissed by the Court of Appeal in 2009.

We agreed to represent Mr. Taitt and counsel were instructed to draft an application for permission to appeal to the Privy Council. In early 2011, we instructed a clinical psychologist and a psychiatrist to travel to Trinidad to assess Mr. Taitt and medical reports were subsequently filed in the Privy Council.

On 8th November 2011, the JCPC allowed the appeal on the basis of fresh medical evidence and the case was remitted to the Court of Appeal in Trinidad & Tobago.
